Welcome to the RSS America LLC Affiliate Program, operated by RSS.com (hereinafter referred to as "we," "us," or "our"). Our affiliate program is designed to reward individuals and organizations (referred to as "Affiliates," "you," or "your") for referring new customers to our products and services through approved affiliate links and promotional methods.
By joining our Affiliate Program, you agree to be bound by these Terms of Service ("ToS"), our Privacy Policy, and any other relevant policies. You must be at least 18 years of age and capable of entering into a legally binding agreement to participate.
To enroll, submit a completed application through our affiliate platform, Rewardful. We reserve the right to accept or reject applications based on our criteria for brand alignment, audience relevance, and promotional methods. Providing false or incomplete information may result in immediate termination from the program.
As an affiliate, you agree to conduct yourself ethically and in compliance with all applicable laws. You shall not engage in spamming, misleading advertising, or any form of harassment. All promotional materials must be truthful, and you must clearly disclose your affiliate relationship when promoting our products.
Commissions are earned on qualifying sales that result from your affiliate links. Self referral sales are not qualifying sales. The specific commission rates, qualifying criteria, and any limitations will be outlined in your Affiliate Dashboard. Commissions are subject to review and verification by our team.
Commissions are paid at the end of the month after a 30 period has elapsed, provided you have reached the minimum payment threshold specified in your Affiliate Dashboard. Payments will be made via the method selected in your account settings. You are responsible for any applicable taxes on your earnings. Commissions are not paid on refunded payments.
You are granted a non-exclusive, revocable right to use our trademarks, logos, and promotional materials as provided through the affiliate platform. These materials must not be altered without our prior written consent.
This agreement is effective upon your acceptance and continues until terminated by either party. Either party may terminate this agreement at any time, with or without cause. Upon termination, you must cease all promotional activities and remove all affiliate links and materials.
We shall not be liable for indirect, special, or consequential damages arising in connection with this Affiliate Program. Our aggregate liability arising with respect to this agreement will not exceed the total commissions paid or payable to you under this agreement.
You agree to indemnify, defend, and hold harmless RSS America LLC and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses arising from your participation in the Affiliate Program.
You may receive confidential information from us during your participation in the Affiliate Program. You agree not to disclose or use this information except as necessary to participate in the Affiliate Program.
We reserve the right to modify these ToS at any time. You will be notified of any changes through your registered email or through your Affiliate Dashboard. Continued participation in the program after such modifications constitutes acceptance of the changes.
This agreement shall be governed by the laws of [Jurisdiction], without regard to its conflict of laws principles. Any disputes arising from this agreement shall be resolved through arbitration in Delaware, United States.
